These Terms and Conditions apply variously to the use of our website and to purchases of services such as training from Agilec.

Privacy

By providing any information or communicating through our website, you are indicating your acceptance of Agilec’s Privacy Policy and Practices, and the manner in which we collect and use personal information through the website.

Agilec may anonymize and use information you provide through our website for purposes such as promotion and/or research.

Purchases of Services and Training

Registration and Password

If you have a password allowing access to a non-public area of the website, you are prohibited from:

  • disclosing or sharing your password with any third parties, or
  • using your password for any unauthorized purpose.

You are responsible for maintaining the confidentiality of your information and password (if provided). You are responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify Agilec of any unauthorized use of your registration or password.

Cancellations and Refunds

An administrative fee of 10% will be deducted from any paid training registrations.

Requests for cancellation(s) must be made by emailing your request to ps@agilec.ca. All cancellation requests must be received before 4:00 pm ET within the following timeframe:

  • Webinars – Cancellation requests must be received two business days prior to the webinar date.
  • In-Person Training (Individual) – Cancellation requests must be received 10 business days prior to the start of training.
  • Group Training – Cancellation requests must be received 30 days prior to the date of delivery.
  • Online Training – Cancellations will be subject to an account review. Refunds for cancellation requests received after an account has been accessed will be pro-rated based on the information accessed.
  • Resume/Document Writing Service – All sales are final. There is no trial or grace period after purchasing the resume/document writing service. Like any writing project, there will be multiple drafts and revisions. Agilec writers will work with you throughout the revision period until you are satisfied with your documents. As a result, there are no refunds once the resume/document writing service has been purchased.
  • Outplacement or Career Transition Services – All sales are final. There is no trial or grace period after purchasing outplacement or career transition services. There is no guarantee of employment when purchasing these services.
  • Exam Invigilation Cancellation requests require a notice of two business days for a refund/credit. No-shows and cancellation made outside of this time period will not be issued.

Refunds will be issued within two weeks after receipt of the written notice.

Transfer Your Registration

Please notify us at ps@agilec.ca if you intend to transfer your registration to another person. Supply us with that person’s name and contact information including their email address. The substitute delegate will be required to pay any difference in registration rate.

Technical Failure

It is the responsibility of the attendee to confirm system requirements and test their computer systems prior to the start of any on-line offering. If a technical failure at the attendee’s home or workplace prevents access to the program or service purchased, the attendee will not be given a refund.

In Case of Inclement Weather or Emergency Cancellation

In certain instances (e.g. weather, trainer illness, etc.) it may be necessary for Agilec to cancel a scheduled offering. In the event of inclement weather/emergency cancellations, registrants will be contacted immediately by phone, email, and/or fax and will be provided with information and instructions for re-scheduling and/or refund.

Insufficient Registration

Scheduled offerings with insufficient registration may be subject to cancellation. If so, registrants will be notified at least 48 business hours prior to scheduled training date and given a priority status for re-registration in another class.

Job Posting Services

Agilec is not an employer or agent of an employer or candidate for employment with respect to any individual or entity using this website. Agilec is not responsible for any employment decisions made by any individual or entity posting jobs on the website.

Posting Rules

As a user, you are responsible for your own communications and the consequences of your posting. You must not, and by using this website you agree not to, do the following things:

  • Post material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it;
  • Post material that reveals trade secrets, unless you own them or have the permission of the owner;
  • Post material that infringes on intellectual property rights of others or on the privacy or publicity rights of others;
  • Post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity;
  • Post a sexually-explicit image or statement;
  • Post advertisements or solicitations of business, including chain letters or pyramid schemes;

  • Or post material that contains viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data or information.

Using Content Posted by Others

Agilec does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.

Agilec acts as a passive conduit for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If notified by a user of communications which allegedly do not conform to these Terms and Conditions, Agilec may investigate the allegation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. Agilec has no liability or responsibility to users for performance or non-performance of such activities. Agilec reserves the right to expel users and prevent their further access to the website for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal, or disruptive. Agilec may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for Agilec or may cause Agilec to lose (in whole or in part) the services of its ISPs or other suppliers.

The Job Posting Service acts as a venue for employers to post job opportunities. Agilec does not screen or censor the listings offered, and has no control over the quality, safety, or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. There are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons, or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the website.

Agilec cannot and does not confirm that each user is who they claim to be. In the event that you have a dispute with one or more users, you release Agilec (and our related corporations, together with our former, current, and future officers, directors, employees, agents and suppliers) from claims, demands, and damages (contractual and extra-contractual, actual and consequential, direct and indirect, punitive) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

We are under no legal obligation to, and generally do not, control the information posted by users. By its very nature, other people’s information may be offensive, harmful, or inaccurate, and in some cases will be mislabeled or deceptively labeled. Limitation of Liability

The aggregate liability for Agilec to you for all claims arising from the use of the website is limited to $100.

Agilec reserves the right, at its sole discretion, to pursue all legal remedies, including but not limited to deletion of your postings from this website and immediate termination of your registration or ability to access the website and/or any other service provided to you by Agilec, upon any breach by you of these Terms and Conditions or if Agilec is unable to verify or authenticate any information you submit to the website.

Idemnity

You agree to defend, indemnify, and hold harmless Agilec, its officers, directors, employees, and agents, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees (judicial and extra-judicial), alleging or resulting from your use of the website or your breach of the terms of these Terms and Conditions.
